Who owns this picture?

I can't imagine how there could be any question, but apparently some jackass in a uniform has other ideas:


Blogger battles Army: Seeks Ted K’s aid in copyright fight

A local blogger is appealing to Sen. Edward M. Kennedy to help him fight the U.S. Army over copyright claims to a heartbreaking photo he took of a young Iraqi girl mortally wounded by a terrorist explosion.

Michael Yon, a former soldier and an embedded blogger journalist in Iraq, took what some consider one of the more famous photos of the war last May — of a U.S. GI cradling a dying Iraqi girl.

The U.S. Army later released the photo, which was flashed around the world and prominently displayed by newspapers, broadcast stations and Web sites.

But Yon, who uses Massachusetts as his blogger base of operations, said he never intended to allow the Army to distribute the photo to commercial operations and he’s now seeking damages. He said he may file a lawsuit within days, claiming thousands of dollars in damages.

I want to thank you so much...I mean very much. I had come across this picture at a site named Military Grrrl. I had found her blog through Milblogs. She had the picture posted and said she took it. I was not aware of this controversy and a friend of mine here from FReepers brought my post to my attention about this. I knew something was not right when I had read your post earlier, but I did not know who to contact, until she emailed me, and thank God. I put up the photo and followed your link at the Boston Herald, quoted a snippet...and that was about it. No thanks plz, I left a hat tip to you.....Because you saved me from much embarrassment. UPDATE: The blog I mentioned above in my previous comments, well, she deleted both her posts as I "swiftboated her". To think that some in our military would disgrace themselves and take credit for what is not theirs then lie about it is shameful. She was so outrageous I had to ban her. Please take a look at the post I wrote. It is truly sad. I am shocked that not all our military men or women have the high moral standard of integrity.
